ARTICLE 1. PURPOSE OF THE CONTRACT
a) DESCRIPTION OF THE YUMI SERVICE
The purpose of these general terms and conditions is to define the terms and conditions of sale and use of the Yumi application by the User.
Yumi makes all functionalities of the application (premium) available to the User in exchange for the payment of a monthly or annual subscription. Yumi provides the User with a food diary allowing her to track her daily nutrition.
The purpose of the Application is to provide users with tracking and analysis tools related to their nutrition and menstrual cycle, as well as informative content and personalized recipe suggestions based on their declared objectives.
As Yumi aims to improve nutrition among women, it may make a free version (freemium) of the application available to Users with restricted access to certain functionalities. However, Yumi is under no obligation to maintain this free access to the Services indefinitely.
Yumi may also offer the premium version free of charge for 15 days or during a promotional period. At the end of the free access period, the User must subscribe to a premium subscription to continue using the premium version of the Services.
The User, whether under a premium or freemium subscription, undertakes to comply with the terms of use of the application.

ARTICLE 2. REGISTRATION, ACCOUNTS, AND SERVICES
A) REGISTRATION
You must create a Yumi account to access or use the Services. When you create an account for our Services, you agree to provide us with accurate and complete information during the registration process and to keep it up to date.
You agree to create only one account for your personal use and not to share your account with others. You are responsible for maintaining the confidentiality of the password associated with your account. You are responsible for all activities performed through your account.
Please notify our technical support immediately in the event of loss, theft, or unauthorized use of your account or password, whether the breach is actual or suspected.
You may delete your account at any time. If you do so, it is generally impossible to recover it.
B) CONDITIONS FOR REGISTRATION

No person under the age of 18 may use the Services or provide us with personal information. We implement technical measures to prevent individuals under the age of 18 from creating an account or using our Services. ARTICLE 3. OBLIGATIONS OF YUMI
It is understood that Yumi shall have an obligation of means (obligation de moyens) in providing the Service.
Yumi undertakes to make all reasonable efforts to:
Make available to the user the functionalities corresponding to the subscribed offer;
Correct, within a reasonable timeframe, any malfunctions, bugs, or errors reported by users;
Regularly collect user feedback to improve service quality and customer satisfaction.
In the event of a malfunction, bug, or outage affecting the Application, Yumi undertakes to make all reasonable efforts to provide appropriate technical assistance to remedy the problem within a reasonable timeframe. ARTICLE 4. OBLIGATIONS OF THE USER
➢ Account Creation and Use
The User undertakes to create a personal and individual account. Any use of the User's account is deemed to have been carried out by her. She is solely responsible for the confidentiality of her login credentials (email address and password) and for any use of her account. The User undertakes to notify Yumi immediately in the event of loss, theft, or unauthorized use of her login credentials.

The User undertakes to provide accurate, complete, and up-to-date information when creating her account and throughout the entire duration of her use of the Services.
She undertakes to update without delay any information that becomes inaccurate or obsolete. Yumi shall not be held liable for consequences resulting from the communication of erroneous, incomplete, or obsolete information.
➢ Compliant Use of the Services
The User undertakes to use the Yumi application in accordance with its purpose, namely as a food diary and a tool to help understand her habits.
The User specifically refrains from:

Any attempt to circumvent the security measures of the application;

Any unauthorized use of trademarks, trade dress, copyrighted content, or any other intellectual property right or goodwill belonging to Yumi or its providers or licensors is prohibited.
Yumi does not grant any express or implied license over any intellectual property right belonging to it. All rights belonging to Yumi shall remain the property of Yumi.
• LICENSE GRANTED TO THE USER
Under these Terms, YUMI grants the User a personal, non-exclusive, and non-transferable right to access and use the Services and the content offered within the Application.

1. Premium Subscription Enrollment

Upon subscribing, the User must provide valid payment method information. She expressly authorizes YUMI and its payment service providers to process, secure, and retain this information in accordance with current security standards and applicable regulations.
Premium Services may be subscribed to on a monthly or annual basis.
Unless otherwise specified, the subscription automatically renews for successive periods of equal duration, and the corresponding fees are debited at the beginning of each period from the payment method provided.

2. Subscription Cancellation

Once the subscription is canceled, in the case of a:
Monthly subscription: the cancellation will take effect at the end of the current monthly period, i.e., after the expiry of the 30 days for which the subscription was paid.
Annual subscription: the cancellation will take effect at the end of the current annual period, i.e., at the end of the year for which the subscription was purchased and paid.
No pro-rata refund for remaining periods will be made, unless otherwise provided by law or in special circumstances expressly accepted by YUMI.
Amounts paid for Premium Services are in principle non-refundable, except under legal obligation or an express decision by YUMI. When enrollment is performed via a third-party platform (such as a mobile application provider), refund terms may be governed by the specific rules of said platform.

3. Automatic Renewal
The subscription will automatically renew at the beginning of each period, unless canceled beforehand.

• Service Updates

However, when the User qualifies as a consumer within the meaning of the applicable law, she may bring the matter before (i) the competent French courts, or (ii) where the mandatory law applicable to the dispute so provides: the courts of the place of her habitual residence.
